1. ORDER ACKNOWLEDGEMENT: To ensure we process your order efficiently, we create a written Quotation and Order Acknowledgment. Please review it for accuracy and if there are any changes, let us know in writing or email as soon as possible.
2. FREIGHT COSTS: All freight costs are extra, unless quoted otherwise.
3. SALES TAXES: All sales are subject to applicable taxes which are your responsibility to pay as purchaser, unless you provide a valid exemption certificate.
4. CHANGES: We understand that unforeseeable events may cause you to delay, change or cancel your order. Unfortunately, we will be required to charge you for our costs up until the time of your cancellation. Please note that custom-made products are non-refundable.
5. PAYMENT: There is a team of people at Crystal dedicated to delivering your products and services on time and on budget. In return, we ask that you respect the terms of sale negotiated and pay your accounts in full. If you cannot meet the agreed upon terms, we will work with you to quickly correct the situation but please note that payment delay may also delay your order or future orders.
6. CREDIT: Credit terms were based on information available at the time of the order. If there is a change in your organization’s financial condition, we will discuss new credit terms to ensure you receive your order and we can receive payment. Once we have been paid in full, your order will become your possession, ownership and responsibility.
7. WARRANTY: We promise that our products will perform according to published standards. Our Crystal Warranty to you is that our products will be free from defects in materials or workmanship for 1 year from the date of shipment. If you discover a defective product, please immediately call or email us so we can quickly arrange for a replacement or refund. You can also view details on our Warranty + Return policy here. Extended warranties are also available on select bronze and brass products.
8. DELIVERY: Crystal will deliver your order in good condition to a common carrier as per our bill of lading.
9. DELIVERY DATES: At Crystal we take commitments to our customers very seriously. We understand that shipping dates are critical to you in the successful completion of your project and we will take every reasonable step to ensure your delivery arrives in a timely fashion. Unfortunately, we can’t be held responsible for delays beyond our control, including acts of God, labour problems, strikes, delivery interruptions, equipment failures and shortage of parts.
10. RESPONSIBILITIES: If you install our product without our supervision and there is a problem, we can not be responsible for the installation. But with our prior written (or email) approval, we will replace defective products for 1 year from the date of shipment and also pay for a reasonable amount of the labor costs for removal and re-installation. We can not accept responsibility for any consequential damages relating to your installation or the subsequent removal of the product.
11. PROPERTY RIGHTS: We have invested time and money to bring these products to market and retain all intellectual and industrial property rights related to these goods or services.

WARRANTY EXCLUSIONS: The Crystal Warranty noted above is the only warranty of any kind either expressed or implied that is made by Crystal. The warranty of merchantability and fitness for a particular purpose are hereby disclaimed. Neither Crystal nor anyone else who has been involved in the creation, production or delivery of the product shall be liable for any direct, indirect, consequential or incidental damages arising out of the use of the product or the inability to use the product even if Crystal has been advised of the possibility of such damage or claim. Some jurisdictions may not allow the exclusion or limitation of liability for consequential or incidental damages, so such limitation may not apply to you.
INDEMNIFICATION: You shall indemnify and save Crystal harmless from any claims for damage or injury to persons or property as a result of any error by you or your agent in the design, specifications or instructions with respect to the product and you shall indemnify and save Crystal harmless from any claim resulting from any alleged infringement of any patent, copyright, trade secret or other intellectual property.
JURISDICTION: These Terms and Conditions of Sale shall be construed, interpreted and enforced in accordance with the laws of Ontario and of Canada applicable therein.
